Terms of Service (General Terms and Conditions)

1. Scope and Provider
These Terms of Service (“Terms”) apply to all orders placed through the online store onefam.shop between OneFam, sole proprietor Labinot Bajrami, Riehenstrasse 236, 4058 Basel, Switzerland (“Provider”, “we”, “us”) and the customer. Deviating terms of the customer are not accepted unless we expressly agree to them.
2. Conclusion of Contract
The presentation of products in the store does not constitute a binding offer. By submitting an order, the customer makes a binding offer. The contract is concluded upon our order or shipping confirmation.
3. Prices and Payment
The prices displayed in the store at the time of the order apply. Prices are shown per market in the respective currency. Payment is made via the payment methods offered at checkout. Any import charges for deliveries to Switzerland or non-EU countries are not included in the price (see Section 7).
4. Production and Delivery
Our products are made individually to order (print-on-demand) and shipped from Germany via a production and fulfillment service provider. Stated delivery and production times are approximate. We only ship to the countries selectable at checkout.
5. Right of Withdrawal and Custom-Made Goods
Because our products are custom-made to the customer’s specifications, withdrawal or return due to a change of mind or incorrect selection is excluded to the extent permitted by law. Details are governed by our Return, Withdrawal and Refund Policy, which forms part of these Terms.
6. Defects and Warranty
For defective, damaged, or misprinted goods, statutory rights apply in accordance with our Return Policy. Defects must be reported within 14 days of receipt, stating the order number and including clear photos, to info@onefam.ch.
7. Shipping, Non-Delivery and Import
The customer is responsible for providing a complete and correct delivery address. In the event of non-delivery for reasons attributable to the customer, the customer bears the return and re-shipment costs. For deliveries to Switzerland and other non-EU countries, customs duties and import taxes may apply and are borne by the customer.
8. Liability
We are liable without limitation for intent and gross negligence as well as for injury to life, body, or health. Otherwise, liability is limited to the foreseeable damage typical for the contract. For slight negligence, we are liable only in the event of a breach of essential contractual obligations.
9. Retention of Title
The goods remain our property until full payment has been received.
10. Applicable Law and Place of Jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the customer’s country of residence remain unaffected. The place of jurisdiction is, to the extent permitted, Basel, Switzerland.
11. Dispute Resolution
We are neither obliged nor generally willing to participate in dispute resolution proceedings before a consumer arbitration board.
12. Severability
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
